『개인주의자 선언』 『최소한의 선의』 등으로 합리적 개인주의와 민주주의의 기본 원리를 유쾌한 필치에 담아온 문유석. 2020년 판사의 법복을 벗고 프리랜서 드라마작가로 전업한 뒤 그의 두번째 삶은 어땠을까? 조직에서 자유의 몸이 된 뒤 경제적 자유와 동시에 정신적 자유까지도 쟁취하며 새로운 삶의 개척자가 되었을까?
누구나 안정된 직장을 버리고 새로운 삶을 시작하기란 쉽지 않을 터, 그 또한 두번째 삶을 결심하기까지 시간은 짧지 않았다. 양승태 대법원 시절, 판사 블랙리스트 등 드라마보다 더 드라마 같은 법원의 결정적 순간을 목격한 뒤 그는 비로소 법관생활을 떠나기로 결심했지만, 그를 기다린 것은 ‘자유로운 삶’만이 아니었다. 조직 안에서 살아남는 것만큼이나 온전한 개인으로 살기란 만만치 않았고 ‘사회’ 속의 분투는 끝나지 않았다.
이제 그는 타인의 삶을 판결하는 일에서 질문하는 일로 업을 바꾸어, 그리고 드라마로 흐려진 정의를 묻는 삶으로 자리를 바꾸어, 새 삶에서 당면한 시행착오와 고민을 풀어놓는다. 재테크, 건강관리, 시간관리 같은 일상적 문제에서 드라마작가라는 직업인으로서 성장까지, 나아가 우리 삶의 바탕을 이루는 법과 민주주의의 작동까지 종횡무진 가로지르며 자신의 좌표를 가늠하고자 한다.
비록 삶의 터전이 바뀌었을지라도 작가는 시종일관 강조한다. “앞으로 내가 몇 번의 새로운 삶에 도전하며 살아간다 하더라도 이전의 생이 무의미해지는 것은 아니다. 그것이 성공이었든, 실패였든” “첫번째 삶과 두번째 삶은 단절된 것이 아니었다”라고. ‘문유석식 전업일지’라 할 만한 이 책은 두번째 삶은 첫번째 삶에 충실할 때만이 도래한다는 것을, 또한 두번째 삶의 실수와 좌절, 불안을 정직하게 쓸 때만이 새 삶을 무사히 통과할 수 있다는 것을 보여준다.

“There are many legal films and television shows, but there are rarely any that tell the stories beyond the courtroom, such as what kind of conversations judges have among themselves in their chambers, what judges give a lot of thought to, and what kind of people judges are in general. In fact, judges are often portrayed as people who sit stoically on the bench, banging their gavels. I wanted to depict the various conflicts prevalent in this society and also tell honest stories about judges who adjudicate such disputes.” (Miseu Hammurabi (미스 함무라비 Miss Hammurabi), Munhakdongne, 2016) Yu-sok Mun is a judge and author who writes realistic fiction about courtroom proceedings and essay collections based on personal experiences.
